The other day, I reported to you that the Governor had vetoed budget provision 436 (all of the 2017 amendments dealing with transportation) in order to kill the language that VTCA supported that would prohibit the Commonwealth from mandating project labor agreements on P3 projects. Well, the saga continues.
Today, Virginia House of Delegates Speaker William J. Howell directed the Clerk of the House of Delegates and Keeper of the Rolls of the Commonwealth to notify Governor Terry McAuliffe of invalid veto actions on HB 1500 (the budget bill). Clerk G. Paul Nardo sent a letter to the Governor, a full copy of which can be found here, explaining the invalid veto of Item 436 of the re-enrolled budget document.
Bottom line…the Speaker of the House and the Clerk of the House of Delegates have determined that the Governor’s efforts to veto Item 436 of the budget (which included Item Q prohibiting the mandating of PLAs) are unconstitutional. Consequently, the state budget will be published as presented to the Governor WITH the prohibition on the mandating of PLAs on P3 projects.
