EPA & U.S. Army Corp of Engineers Release WOTUS Supplemental Rule

EPA and the Army Corps of Engineers last week released a supplemental Waters of the United States (WOTUS) proposal that could bring greater clarity to Clean Water Act requirements for transportation construction projects. 

ARTBA and NSSGA are both reviewing the proposed definitions. ARTBA has posted an initial overview of the key changes.                                              
 
NSSGA will also be preparing comments related to the Supplemental Rule. Please share any thoughts/comments you have with NSSGA. 
 
NSSGA will be discussing this proposal at the September 20 at 3:30 pm meeting in conjunction with the NSSGA Legislative & Policy Forum and have a tentative acceptance from EPA staff to participate.
