MSHA Respirable Crystalline Silica Rule (30 CFR Part 60) – One Year Away

On April 18, 2024, MSHA published the Respirable Crystalline Silica Rule, also known as the “Silica Rule”. MSHA will begin enforcement of the Silica Rule in 1 (one) year, on April 8, 2026, for metal/nonmetal mining operations. Enforcement will commence this month for coal mines.

With enforcement beginning in just one year, VTCA and others more familiar with the Silica Rule are encouraging operators to establish their Respirable Crystalline Silica plans now and begin dust sampling at their facilities. Developing and commencing Silica Rule plans now will provide operators with ample opportunity to address problem areas ahead of MSHA enforcement next year.

VTCA has established a Silica Rule Resource page on our website. This page will provide information and links to resources that can assist in developing plans and complying with the regulations. The VTCA Silica Rule resource page will be updated as VTCA obtains more information and develops additional resources.

VTCA and MSHA are working on establishing a dust monitoring workshop, and VTCA is developing webinars designed to assist operators with compliance. We will keep members informed as these materialize.

VTCA strongly suggests our members become acutely familiar with the Respirable Crystalline Silica (30 CFR Part 60) Rule. If members are unsure of their interpretation of the Rule or how to establish their plan, please consider employing outside assistance to ensure compliance.
